Aarc Platform

PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE PLATFORM. BY ACCESSING OR USING THE PLATFORM, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT ACCESS OR USE THE PLATFORM.
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Plexus Labs Pte. Ltd., a company incorporated in Singapore (UEN: 202342127C) with its registered address at 20A Tanjong Pagar Road, Singapore 088443 ("Plexus", "we", "us", or "our").
Plexus operates the Aarc platform, accessible via www.aarc.xyz (the "Website") and app.aarc.xyz (the "Dashboard") (collectively, the "Platform"). The Platform provides technology infrastructure for users to interact with iBTCY, a tokenized structured note issued by SD Global Capital Limited, a BVI Business Company (the "Issuer"), and BTCY, an ERC-4626 wrapper token (when available).
IMPORTANT: Plexus is a technology service provider. Plexus is NOT the issuer of iBTCY or BTCY, does NOT hold custody of any assets, and is NOT your counterparty for any investment. Your investment relationship is solely with SD Global Capital Limited pursuant to the Subscription Agreement you execute with them. Plexus does not act as your fiduciary, investment adviser, broker or agent in connection with any investment, and is not responsible for the Issuer's obligations to you. Any obligations Plexus may have to you arise solely under these Terms and Applicable Law. For the avoidance of doubt, Plexus may perform compliance, risk management and operational actions in relation to Platform access (including screening, restriction, suspension or termination) without assuming any custody, agency or investment-related duties.
By accessing or using the Platform, you represent and warrant that you have read, understood, and agree to be bound by these Terms. If you are accessing or using the Platform on behalf of an entity, you represent and warrant that you have authority to bind that entity to these Terms.
In these Terms:
"Applicable Law" means all laws, regulations, regulatory guidance, codes of practice and binding directions applicable to Plexus, the Platform and/or you in connection with access to or use of the Platform (including any applicable sanctions, anti-money laundering and counter-terrorist financing laws), as amended from time to time.
"BTCY" means the ERC-4626 wrapper token (if and when made available) described in the applicable programme and/or platform documentation.
